Day X + 21

1 March 2016 if the elections
take place on 9 May 2016

Within 7 days following the expiration date for the works’ council, the prevention committee or the employer, as the case may be, to decide on the objections, filed on or before day X + 14, that is day X + 21 (1 March 2016 if the elections take place on 9 May 2016), the workers, as well as the representative trade unions concerned, can file a complaint against the decision before the employment tribunal.

Such a complaint can also be filed if no decision has been taken (this is not unlikely, since the decisions of the works’ council and the prevention committee have to be taken by unanimous vote).

If no complaints have been filed before the employment tribunal, the data as originally communicated on day X and adjusted, as the case may be, following an objection, are final.
